Problems and disputes

What to do when credit is missing, a work is mislicensed, a licence is breached or a platform blocks reuse.

Stop the challenged use now. Do not wait for a second notice. Under the CC 4.0 license terms, rights terminate automatically upon breach, but you get a 30-day window to cure the violation starting from the moment you become aware of it. Fix it in that window and the license is automatically reinstated. One decisive condition overrides all of this: fair use, fair dealing or another copyright exception operates separately. If a legal exception authorises the use, the license conditions never applied to that use. Your next move is to identify the exact term you are accused of violating, preserve the source page and the license notice, cure the violation if you can, and treat that 30-day window as your only automatic path back to compliance. The guides below each start at a specific question. Find the one that matches what you are trying to do, then follow its instruction.

  • License termination on breach: Under 4.0, rights terminate automatically. They are reinstated from the date of cure if cured within 30 days of discovery.
  • Cure does not erase past liability: A cure reinstates the license prospectively but does not eliminate possible liability for the period of violation.
  • Exceptions operate separately: Fair use or fair dealing may authorise the use regardless of the license. If an exception applies, the license conditions do not apply to that use.
  • Creative Commons does not enforce: CC is not a party to individual licenses and does not decide whether a particular use is lawful.

What To Do When A Use Is Challenged

Stop The Use And Secure The Evidence

The moment you receive a challenge, stop the use. Do not wait to confirm the accusation. A continuing use after notice makes cure harder and liability more likely. Then preserve every piece of evidence: the original source page, the license notice displayed at the time you accessed the work, the date you accessed it, the specific license version named, any exclusions the licensor stated, any modifications you made, and a copy of the communication that challenged your use. A screenshot of the source page with the license notice visible is the single most reliable form of evidence. Do not rely on a platform filter, a search thumbnail or a repost to show the applicable CC terms.

How To Cure A Violation Under 4.0

Version 4.0 gives you a 30-day automatic cure window starting from the date you become aware of the breach. Awareness is not limited to receiving a formal notice. If you realise an attribution is missing or a restriction is being exceeded, the clock starts. To cure, correct the specific condition that was violated. If the issue is missing attribution, add it in a reasonable manner for the medium, link or refer to the exact 4.0 license, and indicate modifications. If the issue is a non-commercial use under an NC license, either cease the use or obtain separate permission from the licensor. If the issue is sharing an adaptation under an ND license, stop sharing the adapted material. Once cured, the license is reinstated from the date of cure. You still may face liability for the period before the cure. Older CC license versions do not contain this automatic 30-day mechanism. Check the version on the original work.

When Fair Use Or Fair Dealing Applies

A CC license operates on top of copyright. If a use is authorised by an exception or limitation under applicable copyright law, the license conditions do not apply to that use. Fair use in the United States, fair dealing in many Commonwealth jurisdictions and other national exceptions exist separately from the license. Their scope varies by jurisdiction. The fact that a work carries a CC license does not prevent you from relying on a copyright exception, and the fact that you rely on an exception does not mean you are free from the license's conditions if the exception does not cover the full use. If you plan to assert a copyright exception, document the legal basis for that assertion in the relevant jurisdiction. Creative Commons does not offer an opinion on whether a particular use qualifies as fair use or fair dealing.

How To Handle The Four License Conditions In A Disagreement

Most disagreements involve one of the four conditions. Identify which one is at issue before escalating.

What To Do Before Escalating

What A Licensor Must Establish

Before you file a platform report or send a cease-and-desist letter, identify the work, the exact condition violated and the cure you are requesting. State clearly what the recipient must do to comply. Platform reporting tools and statutory takedown procedures vary by jurisdiction and carry legal consequences. For a real disagreement, obtain qualified legal advice. Creative Commons does not enforce individual licenses for licensors or decide whether a particular use is lawful.

Check Platform Terms Before Acting

If you are a licensor and the disagreement involves a platform, check the platform's current terms. A CC badge on a platform does not guarantee the platform's terms are compatible with the license. Platforms with exclusive sublicensing terms, download restrictions or DRM can create a conflict.

Route Yourself To The Right Guide

This hub covers the overview. The 10 guides beneath it address specific situations. Find the one that matches what you are trying to do.

  • If you need to correct a missing or incomplete attribution, the guide on fixing attribution walks through each element for version 4.0.
  • If you are a licensor whose work was used without the required conditions, the guide on enforcing your rights explains how to document the breach and request cure.
  • If you are a reuser who received a takedown notice, the guide on responding to a takedown covers what to preserve and when to seek legal advice.
  • If the disagreement involves a non-commercial use, the guide on NC disputes explains the definition under 4.0 and why context matters.
  • If the disagreement involves a ShareAlike violation, the guide on SA compliance covers the compatibility chart and what counts as a shared adaptation.
  • If the disagreement involves a NoDerivatives violation, the guide on ND boundaries explains what is Adapted Material under 4.0 and what is not.
  • If the disagreement involves a platform that restricts reuse, the guide on platform conflicts explains how to check current terms.
  • If the disagreement involves an older license version or a port, the guide on version differences explains the termination language.
  • If the disagreement involves a public domain claim, the guide on CC0 and PDM explains the difference between waiver and marking.
  • If you are unsure which condition is at issue, the guide on identifying the breach helps you map the accusation to the license text.

Who This Licensing Framework Suits And Who It Does Not

The Creative Commons 4.0 framework suits anyone who needs a standard, worldwide grant of permissions for a work they control, and anyone who reuses that work within the stated conditions. It does not suit someone who needs a software license, someone who needs to license patent or trademark rights, someone who needs confidentiality, or someone who expects Creative Commons to enforce their license or determine whether a use is lawful. CC licenses are not a substitute for understanding applicable copyright law, nor are they a guarantee that every component of a work is covered. If you need jurisdiction-specific legal advice, obtain it from a qualified professional.

Common Questions

I was told my attribution was wrong. What do I fix?

Confirm you retained the creator, copyright notice, license reference, warranty disclaimer and URI when supplied. Under 4.0, you must also indicate modifications. Correct the missing or inaccurate element and link the exact license deed. Cure within 30 days of becoming aware of the breach.

Can I keep using a work if I cure the breach?

Yes. Under 4.0, the license is automatically reinstated from the date of cure if cured within 30 days of discovery. The licensor may also expressly reinstate the license. Cure does not erase liability for the violation period.

What if the work uses an older license version?

Older versions do not have the automatic 30-day cure mechanism. Check the legal code for the version shown on the original source. The termination and reinstatement language differs. Preserve the exact version displayed.

Does Creative Commons help me enforce my license?

No. Creative Commons is not a party to individual licenses, does not register works, does not verify ownership and does not give legal advice. Platform reporting and statutory takedown processes have legal consequences. Use qualified advice for a real disagreement.
